Guest repliedI have lived in this country for more than 20 years, but still could not adjust my status in this country. In April of 1984 I married a US citizen, she was in the Army and was stationed in Germany. We got married in New york and went to INS together to file petition and for Interview. The contact representative accepted her leave order, and said that the law state that if the petition has an excuse she does not have to be present on the day of interview. So I went by myself for interview without a lawyer. The first question the examiner asked where is your lawyer, and where is your wife. I told her I dont have a lawyer, as far my wife is concern her information is in the file. Then she tells me that we have to have interview with her to adjucate your case. I told her that we inquired from the immigration authority, Consulate in Germany and the Contact Officer they all said that as the petitioner is on Army duty her presence is not required at the time of interview. She said that it is our mistake. Then I told her if it is your mistake then why I should be penalized, she told me to shut up, If I say another word she will punch me. So she hands me a letter stating that whenever your wife comes back from Army duty to inform this office and that time the interview will be conducted. I send that letter to my wife she changed her mind and took divorce. Then in September of 1996, I applied for Political Asylum, the Board of Appeals denied my case. My question is whether I can reopen my case both for marriage fraud as well as political asylum or just for political asylum. Plus can I sue the INS for missuse of power in adjucating my case for permanent residence. In Feb of 1998, when I got all my papers from INS through Freedom Of Information, I see no paper stating marriage fraud. I paid all my taxes since 1984, contributed towards my Social Security Benefit, plus have contributed towards my retirement plan. Please give me a positive answer what I can do next to live in this country as a good citizen. Yours early action will highly be appreciated.
