  • I-601 Approved?

    Is there someone here who had applied for their I-601 and got approved? Can you please share your experience with us? Do you really have to appear before the court? If you are denied will you be escorted to the airport right away and won't see your family anymore for 10 years? Thinking about this makes me shiver, I can't live without my family.

      I am waiting for my daughter to be called for an interview I am really sorry I cannot share the actual experience with you because we are also afraid that we will not see her for 10 years

          I have actually found document with cases on this link of I-601 cases - unfortunately none of them have been approved but they may give u an insight of what happens at these hearings - the documents were quite interesting

                  It refers to a woman who entered the US using fraudlent document. It is the second case on the list

                    Thanks!!! It was really interesting to read, I just wish that there was more information on why it was approved... not just why the waiver was necessary!

                      i have a daughter who is facing the 3/10 year band - Maybe if u read as many as possible you may be able to identify a trend.

                          So even if I am married to a USC, they still don't consider it , unless there is extreme hardship on the part of your spouse , like his health is deteriorating. I read that site too, (thanks Misty for bringing that site to us) it's really impossible to have it approved. What's next after denial. Do you have to leave the US right away? My God, this is like a life sentence, if you are being deported. What will happen to your family? I thought the govt. is for family unity not it's break up.

                            After the review of the waiver, this is how it was explained to me, it may be possible to have another interview, when approved you'll get the stamp, or if you received the approval in the mail, you can go to INS to have your passport stamp. If denied, INS will process your removal proceeding, then you can appeal to face IJ. For waiver review, your dependents are just your spouse and your parents (should USC or LPR). And during removal proceeding, you can claim your children as dependents. Again you will need to present your case with the reasons such as extreme hardship, good moral character, etc
