Fact is whether one is filing married filing separately or filing jointly, the taxpayer identification number must be provided. If someone is not eligible for a SSN, then a one need to apply for tax number, the ITIn. If the prson fails to place that number or apply for the ITIN, then a $50 civil penalty would be addressed. If willful neglect, a $10000 civil penalty.
What she is doing is within the tax code Davdah. Once the ITIN is obtained, it will not make him more eligible for immigration or any other benefits, not would it make him eligible to work. It is simply a tax number the same way a SSN is a tax number.
