The event day will bring together experts and practitioners on all sides of the EB-5 equation. After each panel, guests will have the opportunity to discuss EB-5 issues among themselves and with speakers.

  • RE-DESIGNATION: Challenges to USCIS’s “re-designation” policy: (a) what pressures are being brought on USCIS to effect change internally? (b) what are the chances that one of the two lawsuits will succeed? (c) is it likely that Congress will promptly enact legislation to over-rule USCIS?
  • SET ASIDES: how fast will “priority processing” be? What is the difference between “priority processing” and “expedited processing”? How will set-asides work: (i) at USCIS? (ii) at DOS’s Visa Bulletin? (iii) at US consulates across the world?
  • FOREIGN AGENTS: How can foreign agents get registered? Can agents start referring investors to projects before they are registered? Will there be dual registration by USCIS or will SEC/FINRA licensed professionals be accepted by USCIS?

  • BUSINESS OF EB5: How does the EB5 industry change with the EB5 Reform and Integrity Act? Do urban projects/RCs have a future in EB5? Which countries are least affected by the increased minimum investment amounts? How do rising inflation and rising interest rates impact the EB5 industry?

Matt Gordon (Discussion Leader)

Matt Gordon is the Chief Executive Officer of E3 Investment Group. Mr. Gordon's career spans business operations, finance and law. Since entering the EB-5 sector, Mr. Gordon has become a noted expert on legal topics related to EB-5 organizational structure and EB-5 policy. He is the editor of the leading legal treatise on the EB-5 program, "The EB-5 Book" and is a frequent writer and lecturer. He has also done policy work at Harvard University's Kennedy School of Government and with the White House. In February 2016, Mr. Gordon testified in front of the House of Representatives Judiciary Committee as a policy expert on EB-5 matters. Mr. Gordon is also a founding member of the More American Jobs Alliance. Mr. Gordon is a licensed attorney in New York, having practiced mergers and acquisitions law at the beginning of his career with the largest and most reputable Wall Street firms including Fried Frank and Sullivan & Cromwell. Following his legal career, Mr. Gordon ran the US division of a Swiss multi-national corporation, after which he became an investment banking and finance professional. Mr. Gordon received his B.S. in Policy Analysis from Cornell University and his J.D., cum laude, from the University of Pennsylvania School of Law. Mr. Gordon holds FINRA/SEC securities licenses and is associated with a registered broker-dealer. Mr. Gordon lives in Westchester County, NY with his wife and three children.

Jennifer Hermansky

Jennifer Hermansky focuses her immigration practice on employment-based immigration. Jennifer has experience serving health care, pharmaceutical and real estate industries, as well as entrepreneurs, scientists and researchers in scientific communities for a wide range of temporary visa options and permanent residence solutions.

Sam Newbold

Samuel Newbold is the chair of the firm's Immigration Law Group. He represents companies from all over the country as well as multinational organizations spanning the globe, providing counsel on employment-based immigration matters as well as corporate compliance best practices. Sam's diverse corporate clientele operates in almost every industry imaginable including, but not limited to, information technology, banking and finance, manufacturing, real estate, hospitality, education, health care, transportation and engineering. Sam has also developed an emerging companies practice - specifically representing foreign entrepreneurs and principals looking to launch start-up companies in the U.S. - and is aligned with several New York City-based accelerators and venture capital firms. Sam is also a member of CSG's Alternative Capital Group and manages the firm's EB-5 practice, representing individual foreign investors, Regional Centers and developers participating in the EB-5 program. He has successfully counselled hundreds of individual EB-5 investors and their families through the entire EB-5 process, as well as dozens of Regional Centers and developers seeking to utilize EB-5 capital in their projects. Sam works closely with the firm's Corporate & Securities and Real Estate, Development & Land Use Groups on EB-5 project structuring to ensure compliance with EB-5 immigration regulations. Sam proudly serves on the Board of Directors for the Safe Passage Project, a New York-based nonprofit that provides pro bono legal services to unaccompanied children in immigration proceedings.

Kurt Reuss

Kurt Reuss is a registered securities broker working exclusively in EB-5 since 2013. He founded eb5Marketplace to allow investors to review and compare multiple investment options with expert due diligence. In 2022, he is focused on projects in the national interest and in rural locations for the fastest processing times possible. He speaks regularly at international conferences about “How to select an EB-5 investment.” Kurt is a registered representative of Finalis, broker-dealer, member, FINRA/SIPC.

Mona Shah

U.K. born, Mona Shah is a dual-licensed attorney and former British Crown Prosecutor. Mona is the managing partner of MSA, headquartered in Manhattan, with an office in the UK.
