Comment: Fathers of Grandfathering

EB5IC (EB-5 Immigration Coalition) and various other parties have been lobbying to get grandfathering language into the new EB5 statute for a long time. Immigration Daily has examined email chains, text chains and their chronology on a confidential basis from a number of parties to try and piece together how the grandfathering language actually got into the new EB5 statute. It is clear that many people and many organizations were involved in making this happen.

Based on the timelines of the evidence we have received, the earliest to work on including Grandfathering into a reauthorization bill was EB5IC. Getting any language into a bill is a long range process and typically many people collaborate bringing to bear each of their own unique strengths to achieve the common purpose by publicly championing, crafting language, privately arguing, and making compromises as called for until language that can ensure passage is arrived at. Both EB5IC and AIIA worked diligently to get grandfathering into the legislation. We believe that it would be fair for both parties to share the credit–and there are likely other parties who also worked to get grandfathering enacted.

It is said that victory has many fathers and that defeat has none. It is natural that many people and organizations should share credit. However, in an earlier issue of Immigration Daily we congratulated a single organization. In light of the evidence we have subsequently received we believe that credit for inclusion of grandfathering language should be shared, with EB5IC being the pioneer in the effort. Good job, all!
