Comment: E2 Investment Visa

  • What: Many EB5 project sponsors are considering coming to market with E2 offerings, some E2 projects are in fact already in the market seeking foreign investors
  • Why: E2 visas have significant advantages over EB5: (1) E2 investments do not pose any restrictions on location through TEAs , an E2 investment can be literally anywhere in USA (2) much less waiting time to receive E2 visas as compared to EB5, so investors get "instant gratification" to live and work in the USA with work authorization for both principal investors and their families (3) much lower level of investment is required to secure the E2 visa, so the market of prospective investors is considerably larger
  • How: To do E2s: project sponsors need two professionals: (a) an experienced immigration attorney familiar with E2s, and (b) an experienced corporate attorney with ability to slice and dice a business venture into "E2able parts". Just a handful of attorneys have serious experience with E2s, and we are in touch with a couple of these, so should you need a referral to attorneys under (a) and/or (b), we are happy to make a courtesy introduction (please bear in mind that we receive no fees or kickbacks for the referrals, all we get is good will).

  • Due to retrogression, EB5 India market is shifting from Indians in India to Indians in the USA on H1B
  • Indians in USA will be the single largest EB5 market in the world during 2020, accounting for 25% of all EB5 investments at the $900K level during 2020
