Comment: Election Sees Immigration Enter Stage Right
Deliberate inaction by House Republicans on S. 744, the bi-partisan Senate bill on immigration for the 113th Congress implies, in strict legislative logic, strong support for the immigration status quo on the part of House Republicans. In other words, one can properly impute that House Republicans are hunky-dory with our current dysfunctional immigration system by Republican inaction on the Senate bill. So, interminable waits for benefits, a crazy-quilt enforcement system, and an underclass of undocumented Americans is what Republicans are clearly, through their inaction, supporting. Now, an argument such as the above is one thing, the hurly-burly of an election is something else. If, in fact, House Republicans had a scintilla of an excuse, other than the above, for their lack of action, surely the pressure of the election season would lay such bare for inspection. In fact, the reverse is happening. Mr. Goodlatte, Chairman of the House Judiciary committee, the one with direct responsibility over immigration in that Chamber of Congress, has threatened a "lawsuit" should the President choose to exercise his discretion. While impeachment is a constitutionally available option for the House in disagreements with the Executive, suing is a constitutionally laughable dodge. There is a proper constitutional option for Congress on immigration, which Congress has, on its own, thrown away. In fact, this option is uniquely the House's, and if Republicans were serious about curtailing the President, they should be clamoring for it. The solution is simple: do away with application fees for immigration benefits. It is precisely Congress's abdication of its appropriation noose that will permit the President to fee-in benefits such as Deferred Action For All (DAFA) if he should choose to exercise his discretion. The House has been given the power of the purse by the Constitution, and it has abandoned it. Should Mr. Goodlatte and his Republican colleagues be serious about stifling the President on immigration, they should immediately prohibit collection of fees by USCIS, and fund USCIS out of general appropriations. Money talks, much louder than any lawsuit. Fees for services are a fascist abomination, and a scourge on the American Republic. If there is no appropriation for a government service, than such service need not be provided at all. If it is a proper government service, there will be public support for appropriating funds.
