Comment: Twice As Much LCA? - This past July, the DOL published proposed changes to the Labor Condition Application (LCA), Form ETA-9035. While these changes purportedly support the integrity of the H-1B process and guard against abuse, they would also double the length of the form and require certain disclosures of financial and personal information that have never before been expected in the H-1B context. Employers see the potential changes as unnecessarily adding to the time and expense of hiring H-1B workers and also allege they are unnecessary, noting that this is also not a system full of rampant abuse. In a recently-published report for the National Foundation For American Policy (NFAP), R. Blake Chisam is sharply - but understandably - critical of the proposed changes. Click here to read about seven disturbing consequences that are likely to occur if the DOL's proposed changes take effect. After reviewing both the impact of these proposed changes and the flimsy rationale on which they are based, it is tough not to conclude that the DOL is tilting at windmills on this one. Do you agree?
