    Could someone please tell me what the requirements are to establish residency in California, I used to live there but had to move to Florida due to no work in California. I have to file my immigration papers in California due to a prop 36 issue that falls under the 9th circuit court decision for first time offenders. ( Florida 11th circuit does not share that decision)

    First, if you have moved residency, then you need to have your issue with DHS moved to the jurisdiction of your actual residency.

    Residency is determined where you actually live. If you work in Florida, then you live there as well, unless you fly to work every day from California.

    You cannot claim California residency by just having an old CA ID or DL. If you get stopped by the police in Florida, they will cite you for living there but not having a FL DL.
