Thread: SAMMY, 4NOW, others---->Volontary Departure???

    Here is the letter I received from BCIS...

    "You are granted to____________to effect your departure from the United States voluntarily, without the institution of proceedings to enforce your departure.

    If you fail to depart from the United States by the date specified, proceedings will be institued to enforce your departure"

    They didnt put a date, do I have 30 days, 60 days??? And from when??? From the day the AOS was denied or from the day I received this letter?

    Is this what they call "Being granted volontary departure"???

    If I leave right away, what are my chance of Fiance Visa??? My Mom is sick I need to go see her.

    Im so sorry Casandra for the situation. its such bad timing. In anyway..this is not legal advice. its just my opinion and I hope Sammy will answer you soon. But I would get married and file your papers BEFORE you leave!!! (Actually yesterday would have been good.) especially the 1-130 petition Complete the packet again like the first time. 1-130/485/864/765 and new pictures. you will also have to file for advance parole now too. Submit them together at your local BCIS office if that is procedure in your state. If you do this.. Make sure you are carrying your divorce decree and your new marriage certificate with you at all times until this new apps can be processed.

    Sincerely best wishes. I know you have to to for your moms sake. and that is the priority, but please be wise and make a decision that will all over benefit everyone involved.

    Can you tell me a little about your situation?
    Was your I-751 denied?

    Not I-751.

    My AOS for CPR was denied, but that doesnt have anything to do with the BCIS...it was supposed to happen, since I and my USC husband got divorced before we even had an interview...

    There is no surprise about it, its the way its supposed to be.

    There is no surprise about it, its the way its supposed to be.
