Thread: removal pls help..Thank you RRV :)

    I am married to a USC and I filed for statut adjustement.INS denied my application for misrepresentation. I came to the states with a visa tourist and did not tell them that my husband was USC so they said it's a misrepresentation. I appealed twice but was denied again. Now they ask me to leave the country if not they will start the process of deporting me. My lawer said that we have to wait until we hear from the INS so we can go to the Court. Another lawer said that I need to contact them right now and ask to go to court and let a judge decide. It been 8 months since I heard from the INS. I don't know waht to do next...Act or wait...please help. I have 2 kids USC too. it's really hard. I didn't leave the country for 5 years. I f I leave am I able to apply again within
    my country consulate ? Or will I be denied the reentry for ever. please help..thank youuuuuuuu

    Thank you rrv for your reply...everything was denied. What's I-130 ? is it late to file that one ? do the INS contact you to telle you when to leave the country or do they send you an appointment to appeatr in front of a judge ?
    I have been fighting 5 years for my case and willing to fight more for the sake of my family.
    Useless to say how hard it is

    if you don't know what I-130 is then you need to get a lawyer. I-130 is the first application your spouse is supposed to fill out and send it to the INS. If you go to the INS web page all the things you need to do are listed there. Good luck.
