Thread: How can I stay?

  1. #1
    Hello,
I came in the US in May 2003 on a J-1 visa. Two year rule does not apply. I was accepted as a student in OCC, a two-year comunity colege in NJ and aplied for status change from J1 to F1. This I did couple days before my J1 expired (Oct. 14). Now I was asked by BCIS to show additional evidence(affidavit of supp.,travel arrengements, proof of citizenship other than US) Now what exactly should I do and what are my chances of getting the F1? Is there any other way of staying legally in the US for me,because this is what I actually need?Should I register for school now or no?
And Can anyone tell me a good lawyer in NJ,Ocean county or close to?

Im not sure how this works but i understand after 911 one has to go back to there home country to change there visa status from a visitor to a student... not sure though its better if you talk to a lawyer about it. weight all your options

just show them the additional evidence they requested, if you have nothing to hide.
and the new rule is that you cannot register for classes unless you actually changed the status to F-1. By the way, some people I know transferred to other schools as students and remained in J-1 status without changing it to F-1.
That is from J-1 exchange student - to J-1 still a student but a different school.

Of course community college may not have the ability to issue J-1 status, and in that case you will have to look into other schools.
