    i was petition for by my u.s. MOTHER I WAS OVER 21 AT THE TIME ACCORDING TO THE VISA BULLITINE MY VISA NUMBER IS AVAIABLE I MAIL IN THE AOS/EAD ABOUT A WEEK AGO HOW LONG DOES IT TAKE FOR THE WORK PERMIT IM IN ORLANDO AND IM NOW OUT OF STATUST

    i think you can't get adjuatment of status if you run out of status!
    i assume you didn't receive any letters from BCIS yet???

    In about 2- 3 months you will receive your EAD and a letter for fingerprinting. I guess you had entered legally on Visa, there should not be any problem with your overstay here. Immigration Department may ask you for a Waiver.

    To Umesh Passi:

    I received a letter from BCIS only now(over 6 months after I apllied for AOS).
    They scheduled 06/14/03 for my fingerprinting.

    Can you, please, help me clear up the following doubts:

    1) Is is possible to do fingerprinting on a Saturday(06/14/03)? If not, how/who can re-schedule this date?

    2) Is that true that only after fingerprinting they will send the applicant an EAD or have an EAD interview scheduled? What type of question do they ask in an EAD interview?

    3) Does fingerprinting come before EAD, I mean, does everybody fingerprint before getting their EAD?(I though it was done as a preceding step for the main interview)

    4) How long does it usually take after fingerprinting to have your AOS interview scheduled? (at LA local immigration office)?

    The answer to your questions is that IT DEPENDS on where you apply. In Boston you get your EAD the same day you hand-deliver application for AOS. As for Saturday, yes thats possible. If am not wrong, the fingerprinting is done by the FBI, and even if you miss the interview and go to the SBI of your state, they will still do the prints and send them to NSC, because you MUST have the prints in before they get you an interview because they want to see if you are on the crime database which would make you ineligible for the whole process and so no interview. If I were you, I would attend the interview even if its at Sunday midnight because that way your paperwork moves faster. If you start skipping stuff, you will be going to the back of the line and so it will take you longer to deal with BCIS, and I dont think you want this.

    HELLO,
    I applied in LA(local office). I have no intention of postponing the fingerprinting, quite the oposite, I just thought they did not work on weekends(Saturdays), and they had miscalculated the date.
    I also know the reason why I have to fingerprint before the interview.No problems about that! Actually, I'm glad they finally scheduled something for me!!!
    What puzzles me is the fact that:

    * it took over 6 months for BCIS to schedule fingerprinting, and only after doing that I will be granted my EAD??!!

    * does verybody fingerprint before EAD interview or usally before interview for GC?

    * does EAD interview count/apply for the GC? If not, why do they request some people EAD interview while others get their EAD right away through mail?

    To Guesty:
    It all depends on offices where you had submitted your AOS papers. Usually EAD is issued in 2- 3 month. Immigration Support Centers where fingerprints are taken are different than Immigration Department. In their letter they must have assigned you a particular Immigration Support Center for fingerprinting. If you can not make on the particular date, you can reschedule with them your fingerprinting. In Immigration letter they always give you address of ISC and instruction in case to miss scheduled appointment. After fingerprints it usually takes 3 - 6 months for Immigration to schedule AOS interview.
