Thread: if or what waiver will i need

    im waiting on my FBI file being received by the embassy, i was refused entry into the US as i had previously overstayed a visa waiver by 120days, the numbers 8cfr 217.4(9)(1) was wrote in my passport, which i believe means i was ineligable to use the visa waiver program, will this affect my chances of obtaining my visa without a waiver, if i do need a waiver can anyone tell me which waiver i will need, as i would rather have it filled out ready at my interview, any advice would be appreciated

    Assuming that you have no other problems, your biggest hurdle will be convincing the embassy that you will obey US law. ON your last trip your apparently did not and will have a tough time explaining why you "forgot" to go back home after 90 days.
    So unless you committed an undisclosed crime or fraud or stayed 180 days past the first 90 on your last trip, you should not need a waiver. BUt don't expect the visa to be handed over any time soon.

    no i did not commit any other crime, or have not committed any other offense in my life, i overstayed 120days over my 90day waiver, my airplane ticket home was sept 13th, i stated all this when i sent in my packet 3 to the embassy as well as a letter from my husbands congressman whom we visited on several occasions regarding my overstay, my only crime was being oblivious to the visa process and law
