Thread: Son's Father is a US citizen but can't find him

    My friend is from Venezuela and is being petitioned by her US citizen brother with a priority date of 30JULY2007; however her ex-husband is a US citizen whom she has an 16 year old son with. He is not around anymore, she is remarried - his name is on the birth certificate and a petition was out there 16 years ago, but never went to the interview with him, he was very abusive and at the time she was only 20years old. Can her son still become a US citizen?

    Most likely not without the help of her ex-husband. In order to get citizenship recognized, son would have to prove that father had been in US for at least five years after age of 14 and would need to provide a letter that he would support the son. There may be other options but she might have to talk to an immigration lawyer.

    If the father of the child was a citizen and had the requisite number of years residency in the U.S. and the parents were married at the time, the child is a U.S. citizen. All you need is the birth certificate, proof of the father's citizenship, and proof of his residence in the U.S. the requisite number of years. Cooperation from the father makes it easier but is not required. If the child is illegitimate then you are out of luck.

    Where he(16 years old) was born?If born in US he is already a citizen, If outside then father had to register him .
    lets elobrate more..

    The child was born in the US, however the father is no longer in the picture,,, the 16 year old lives with his mother who entered as a vistor (B1B2) and of course she never left- Can the child petition the mom when he is 21 years old?
