    Does anyone know if you have applied for a particular visa can you apply for a different one if that one doesn't seem to be going anywhere? We have a fiancee visa on Admin Review in Indian (yes the infamous Mumbai) but if he can gets a job offer from here and his employer wants to sponsor him can that be changed? Just a question? We are looking at all options.

    yes, he can then come here on H1 visa and later on, after you are married, adjust his status to that of LPR. H1 visa has a dual intent, which means that he doesn't have to prove connections to his homeland and non-immigrant intent.

    If he applies for another visa and gets approved I highly doubted in this case since 'immigrant intent' has already been shown on his part, but if he is successful and comes to US and marries you most likely AOS will be denied for 'Visa Fraud'.

    You might want to consult a good lawyer... H1B has duel intent but since there is fiancé visa pending and in admin review ... I doubt ... this will be a good way to go... I think you should wait ...so things don't get complicated. What is happening with Mumbai ? No idea. Lot of people are having the same problem... Wish you all the best...Pasha

    I guess Mumbai is overwhelmed with applications for fiance visas, since there are many Indians trying to come to the US.

    I think it depends on luck only in Mumbai .... Coz when I got my visa from there... there were people visiting that consulate for last 2 yrs and frustrated like h e l l and ( thank god) I walked out with visa just in one day... so don't know what are their strategies ...

    I have talked to a lawyer who said the same thing wait it out. Its very frustrating not knowing what is going on and waiting we are at 50 days since last interview and waiting and waiting and waiting. He is about to leave the country to go back to work in Europe and they still couldn't tell us what will happen then. Well plan B is that I will leave the states later this year to join him overseas, guess our life will be there not here.
