Thread: h1-b visa

    i have a multiple entry visa valid till August 2003

    i'm in India.Initially when i got my visa by March 2001, my consultant told me to wait for 6 months citing market conditions. Then after 9/11 he told that it is not at all possible.

    but now he says that i have to pay $4000 as security deposit without disclosing any reasons

    i need advice on the following.

    1) am i eligible to get into america at this point of time even after 2 years of visa period has expired?

    2) do i need any authorization letter or any legal documents for verification at port of entry when i come over there?

    3) i have a multiple entry visa valid till August 2003.Can i come on my own and try my luck there as some companies which i applied need me to be present there to arrange interview?

    4) is there any other company/consultancy/agency willing to transfer visas.


    Kindly help me.

    I'll try to help... I do a lot of visas for Indian nationals who are Software Engineers and Programmer Analysts .. My responses are in capital letters.

    WELL, YOU CANNOT ENTER THE U.S. UNLESS YOU ENTER TO WORK FOR THE EMPLOYER THAT PETITIONED FOR YOUR H-1B VISA. THE H-1B VISA DOES NOT ALLOW YOU TO COME IN THE U.S. AND LOOK AROUND OR WORK FOR ANOTHER EMPLOYER. HOWEVER, IF YOU DO COME IN THE U.S. TO WORK FOR THE EMPLOYER THAT PETITIONED ON YOUR BEHALF, AS LONG AS THE VISA IS STILL VALID, YOU CAN COME IN UP UNTIL THE DATE OF EXPIRATION.

    2) do i need any authorization letter or any legal documents for verification at port of entry when i come over there?

    IT IS ALWAYS A GOOD IDEA TO BRING A LETTER FROM YOUR H-1B EMPLOYER PRINTED ON THAT EMPLOYER'S LETTERHEAD AND SIGNED BY THE EMPLOYER DESCRIBING THE COMPANY AND YOUR DUTIES IN THE U.S.

    NO. YOU CANNOT.. THE H-1B IS EMPLOYER-SPECIFIC. THAT IS, YOU CAN ONLY WORK FOR THE EMPLOYER THAT PETITIONED ON YOUR BEHALF. YOU CANNOT COME IN THE U.S. AND FIND WORK ON YOUR OWN. TO DO SO, JEOPARDIZES ANY FUTURE ATTEMPT TO CHANGE H-1B EMPLOYERS AND TO OBTAIN ANY OTHER IMMIGRATION BENEFIT.

    4) is there any other company/consultancy/agency willing to transfer visas.

    WELL, I WOULD DEFINITELY SUGGEST THAT YOU LOOK FOR SUCH AN EMPLOYER IN INDIA, OTHERWISE YOU RISK LOSING YOUR CHANCE TO EVER GETTING IN THE U.S. BY COMMITTING VISA FRAUD AND/OR GOING OUT OF STATUS. THE BIG THREE IN INDIA ARE TATA, INFOSYS, WIPRO. I'D ADD I-FLEX.

    there are a lot of Indian companies that do H1for u. it depends on ur qualifications and the likehood of u getting a job here. It wont be a permanent job with one company but something like a contractor. This goes for the software field the most. what field r u in?
