Thread: Please Help!!! Filing N-400 while separated

    I will be filing my N-400 based on 5 years as a permanent resident in a few days. I am separated and my divorce should be finalized in a month.
    My question is: What should I list as my CURRENT Marital status?
    Separated is not an option on the form, the form list Married, Divorced, Annulled or Other.
    Thank you.

    If you file before the divorce is finalized, state you are "married", if you file after the divorce is finalized, state "divorced." The information you put on the form should be correct as of the date you sign it, as you are signing that all the information is true and correct under penalty of perjury.

    Don't worry about this too much. All applicants for naturalization are interviewed, so you can clarify or correct to your current marital at the interview. The divorce will not affect your eligibility for a green card.

    hi...
    your marriage status shouldnt affect at all on your N-400 as you are filing based on 5yrs PR...Just write the status whatever you have at time of filing N-400 Form and you should be ok. Good Luck. Pasha...Listen to lawgal....he/she knows it better....
