Thread: Question about I-751/condition removal

    So, I married the love of my life about two years ago, got the conditional green card, and we started building a life together. I'm a citizen of Norway, and my wife is a US citizen.

    The two year conditional period is almost over, and since I was not employed by any company the last year I forgot to keep up with the deadline for submitting I-751. Stupid me! Now my conditional GC expires in about 3 weeks and the instructions say that I was supposed to have the petition in 90 days before expiration, or my residency is 'automatically' cancelled.

    Am I in trouble? Can I submit I-751 three weeks before my GC expires and be ok? Will I get something that allows me to work in the meantime? (I have taken on a new job recently).

    Aside from being late, I have a legitimate case with supporting documents (joint mortgage and bank account, affidavits/testimonials, etc.), and no prior violations of immigration or other laws.

    Any advice is greatly appreciated.

    You should file I-751 as soon as possible with all supporting documents. Rules says that you can apply for removal of conditions 90 days prior to your second anniversary. So you should not waste any more time.

    If the USC spouse won't cooperate the conditions most likely won't get removed, instead you'll be placed on deportation.

    Umesh, thanks for your reply. I have prepared the paperwork to file immediately following memorial day holiday.

    Roger, thanks for your reply. My USC spouse and I are still very happy and I don't foresee any problem with showing that our marriage is legitimate. She's of course cooperative because she wants me to stay.

    They have to get your paperwork before your GC expires, not sent, they have to get it then...so send it fast...

    Send it today by express and/or registered post. The BCIS must receive the application and all your supporting documents, before the expiration of your conditional green card.

    This is the same date, as the second anniversary of the date that the card was issued. So act fast in order to avoid being put in removal proceedings and thus avoid a lot of stress and attorney fees.
