Thread: VISA Question??

    My first time on the discussion board, my friend's priority date is 6/4/1993 - his mom is a citizen from Mexico and he is over 21 never married. He has been here for over 11 years, he EWI when he was a child. When we were looking on the visa bulletin board he said 1st preference for Mexico is 8/1/1992, is he eligible for his mother to file an I-485, or does he have to wait? Thank you for your assistance.

    He is not eligible to file the I-485 yet. He will not become eligible until the visa bulletin for First Priority for Mexico shows a date of 6/4/1993 or later.

    He can file, but will have to get a visa in Mexico, but will be subject to the 3, 5, and 10 year bans due to his EWI.

    With 06/04/1993 I-130 priority, the alien is a beneficiary of INA Section 245(i) coverage under 01/14/1998 cut-off date, that when his preference becomes current he could file Form I-485A supplement with $1,000.00 penalty despite his EWI.

    What you said is not what the rule says, but it's what you want the rule should say.
