In what status is a person who applied for an employment petition AOS (Form I-140) from H-1B visa?

What is s/he is suppouse to say when at the Social Security Administration they ask for current INS status?

Is the H-1B status still valid?

    status is called pending AOS.
As far as I know, if you don't use EAD, you are still in H1B status, that is, if something happens and AOS is denied, you will still be in H1B status as far as your legal status is concerned.

If I was awaiting approval of I-485 and my employer laid me off (assuming I am working with EAD), could I apply for unemployment (collect unemploymwnt) with the Social Security Administration?

You can apply for unemployment compensation for your State unemployment office. You must qualify based on enough earnings and enough quarters worked. This will determine your weekly benefit if eligible. these monies are paid from funds contributed by the employee and employer deducted as UC insurance.

The Soc Security Administration has nothing to do with this at all.
