    I entered U.S. with my husband and 2 years old daughter legally as tourist last Dec. 12, I did not know that his plan was to leave me and my daughter with my family. I do not know where he's at right now, probably somewhere in L.A. with his friends, he left me a letter that he was sorry and he will send me a divorce paper to be signed.
    To make the long story short....somebody proposed to me. My problem is I am not divorce yet, and our passport was stamped no change of status. I do not know what to do. Do I have to go home first and start the fiancee visa? or marry here? please help...

    What your husband did to you and your child is despicable. What you can do now is ... "get up, and start a life with your daughter." Try to be firm, brave and believe you can do it because you will do it. Don't jump into another relationship because you are still grieving, you might regret this decision in the future. Believe in yourself, don't ask for pity. What is your educational background? You might have some skills that we need here in the US, that's one way of staying here legally.If you really want this US guy, my advice for you is to go home and process your fiancee visa, that's the quickest way of coming back to US without any hassles.Goodluck and may God bless you and your daughter.

    If you are a Filipina as suggested, go see a lawyer experienced in Philippine to U.S. migration. This is a legal minefield.

    If you return to the Philippines, there is no legal divorce and you cannot get a fiance visa for the U.S..

    Even though your visa is stamped "no change of status" it may be possible to get a waiver to stay if you marry a U.S. citizen. Maybe someone else can suggest a good lawyer. Although the cost is high, the cost of bad legal advice is higher.
