    I AM VERY SORRY TO THAT CSPA DOES NOT COVER
    F4 OVER 32 YEARS CHILDRENS.
    I HAD A STRONG ARGUMENT WITH CONSULAR OFFICER
    AT THE TIME OF MY VISA INTERVIEW.

    UNFORTUNATELY IT DOES NOT COVER, EVENTHPOUGH
    LAW WAS MADE FOR US.

    THESE AMERICAN OFFICERS ARE CLEVER TO TWIST THE
    LAW THAN ANYBODY ELSE IN THE WORLD.

    KEEP TRYING AND POST THE DEVELOPMENTS.
    ALL THE BEST.

    over 32 years old children?

    Hello u mean to say that if the child is less than 32 years that he is eligible according to new law in F4 category???is it so???

    The original intent of the law was to help the aged out children.

    The state department and the INS have turned it into justifying processing delays. You see the processing delays for approval of the petition have been caused by the INS ( or in future its successor agencies).

    Now they can say that those delays have been nullified because CSPA does not penalize the the "child" for processing delays.

    The original intent was not to help because of only processing delays. It was to help the aged out children because the visa categories were so backed in awaiting a visa number.

    All in all, to the potential beneficiaries of the CSPA, this has been a big bureaucratic let down.

    Hi All,

    There is still hope....

    The key i feel is when "age-out" occurs.

    Age is determined on the day of visa availibitily. Thus it follows that only on that day it can be determined whether age-out has occured or not.

    The interesting point is can one argue that if visa number became available after 6th Aug 2002 then the person has aged out after the law went into force and hence is eligible for CSPA benefits.

    HI all

    I think...It is still hopefull and there is some restriction On CSPA thats not public.So only consular posts only know about it and they are giving visa base on that and we cant challenge them on that.Because if we consider that Mandeep Patel is telling right that he has got the visa for her daughter then there is still hope.

    And the thing is SO many people are chating on this but Only few are comming and sharing their exp after interview.

    This CSPA covers those children who r 21 to 31 years only?

    If yes, then the children who are 24 right now - CSPA may be applied or not?!!
