Thread: Difficult Case!

    My brother was a resident for 20 years. He was then accused of murder in Mexico in 2000. He then Escaped from the Mexican prison, and came to the U.S. entering with his Residency. He was picked up by Immigration not too long ago and is now going to be sent back to Mexico. Is there any Law that can protect him from going back.

    No. There is no such law which could protect him. Because of that conviction, he is deportable. So he will be extradicted to Mexico.

    Umesh PAssi,

    I know that this is an aggravated Ferlony in the U.S. and he is deprtable for that reason. But does BCIS also concider crimes convicted of in other countries as deportable?

    Yes BCIS considers it as the same way as if committed in this country. Moreover, we have extradition treaty with Mexico, as such he will be sent to Mexico asap.
    Unfortunately, there is nothing anybody can do. If you can arrange for a good Attorney, he may only delay his extradition but nothing else.
