Thread: How to setup Immigration hearing at the airport?

    If the person arrives at the USA airport with VIsa in passport and Immigration officer finds out that person have either 3 year bar or visa is canceled. He will ask person to leave back to country of origin. What if the person is not agreed to ins officer and don't want to leave & will ask for immigration hearing before judge. Is it possible to have immigration hearing setup? Will they release that person till hearing or they will put that person to the detention facility? WHat kind of option person in that situation have at the airport other that asking for Asylum.? Please share your experience and advices are welcome too. Thanx

    A landing alien; a alien who is arriving at the airport has no right to a court hearing. it doens't matter if the alien is a greencard holder or not. If the inspecting officer believes that there may be some basis to the claim that the alien has a legal basis to be in the U.S. he or she might let the alien in on a parole on discretion. Likelyhood of that? next to nothing. More likely, an alien with just a simple visitor's visa will not be aloud in and will be removed expedititly. If there is a barr of inadmissiablity and such an alien attempts to enter -such as by showing up at the airport or borther- the barr of inadmissiability will be raised because now there is a expedite removal in the record.

    If you've got a barr, wait it out or obtain a waiver!

    What if that person will ask for asylum at the aiport after officer will ask for removal? Will they setup asylum hearing? What are the chances being release till the hearing? Anyone had any experience like that please help.
