Thread: Withdrawing a I-140 Employer Petition

  1. #1
    Hello,

Once the I-140 petition has been approved by the BCIS, can the employer withdraw the petition?

    Thanks.

Yes, the employer can withdraw an approved I-140. Reasons for this include: layoff, changes in business needs, changes in corporate ownerships/relationships, etc.

Thank you. Is there a time limit within which the employer can withdraw the approved petition? I have already filed I-485. I have heard that I can move to a different organization to an equivalent job and still continue the same I-485 processing! Is that correct?
