    Hello everyone;
    I have a question and I hope you guys can help me! My mom came to visit me (florida) six months and 6 days ago. When she was at immigrations in Miami the Officer gave her six months period as a tourist. She was supossed to leave U.S. on May 7th. But her flight was cancelled because of the swine flu . The airline changed her ticket to May 16th. Now, my question is: Will she have problems at immigrations when she come back to Florida? I want her here for christmass!

    I wouldn't have thought it would be a problem. She didn't intentionally overstay and there was a good reason why she couldn't leave as originally planned. In immigration officer may ask her in a future visit why she overstayed. I'd make sure I had evidence of why it happened with me. The penalties for an overstay (ie. ban) only begin after 179 days of illegal presence has been accrued past the authorized period of stay.

    You will. You should have either applied for an extension before her time expired or you should have gone the the CBP Deferred Inspection Office to get satisfactor departure (an additional 30 days). Since she violated her status, her visa is now automatically cancelled. A cancelled flight is no excuse, as there are numerous flights leaving the U.S. every day. You don't get to say I only want to take a certain flight on a certian day.

    She will need a waiver for the new visa she applies for.

    Do not just ignore this, as on her next entry, she will automatically be flagged. She will not be allowed to enter on her next visit. You don't want to make her go through the refusal process, as an expidited removal will mean ten years exclusion and a withdraw of application will result in no new visa being issued.

    Go to the embassy, explain the situation, apply for a waiver and the new visa. Be prepared to prove that she is not living in the U.S. on a non-immigrant visa. Also, the embassies now check for welfare use.
