    Withdrawing I-751

    Hello all! First off I'd like to thank you for taking the time to read this.

    I recently got a letter back saying that my I-485 (which I applied with my husband as sponsor) was denied because I still had an I-751 case open under my dad. My lawyer did send in a letter requesting the withdrawal of that I-751 but I'm not sure if it's because they didn't receive it or because my lawyer sent it in after the interview with my husband, but evidently it was not withdrawn.

    That being said, my lawyer recommended that I go to the USCIS office and speak with an immigration officer to withdraw my I-751, but I have read on this forum and many others that I can just send in a letter. Of course, I'd do anything to withdraw that application, but the closest USCIS office is 3 hours away and as a full-time student with a full-time job, it can get quite difficult to match my schedule with appointments available on INFOPASS. So if I can just send in a letter, what exactly should I be including?

    Also, if the I-751 does get withdrawn, do I have to re-submit my I-485 with my husband? Or does it just get taken care of on its own? If it helps any, my I-130 got approved and I have received my work permit.

    As you are already a permanent resident, you are not eligible for Adjustment of Status.

    I think you need to make a discussion with an immigration lawyer. If you are in New York then you can contact this nyc immigration attorney and he is an experienced and knowledgeable immigration lawyer in nyc area.
