Thread: Live in Canada - can I work in US?

    This may not be the right site to ask this question, but do you know if I would be able to work in the US as a Canadian contractor if there is a blemish on my criminal record? I have received a pardon from the Canadian government 6yrs ago - should I apply for a pardon from the US government? Is there a way to do this?

    The INS does not recognize pardons or waivers of any kind. Saying that, there are waivers available, depending on the circumstances. Basically, if you have any criminal record (this includes juvenile offences) you need to see an immigration attorney to make sure you don't end up being barred. Aside from that you can't work in the US without a visa, the easiest being the TN. Check this site out for the requirements. Other option is H1-B or L, but it doesn't sound like that would fit your situation.

    If you received a pardon from Canada, I know you can apply for a waiver to VISIT the US. Whether or not you can get a work visa, I am not sure. By the way, an excellent Canada -> US employment immigration based website is www.grasmick.com.

    I'll leave it up to others to answer if you will have problems due to your now pardoned criminal record.
