Thread: AOS too long

    Hi, I am new to this board. I would very appreciate anybody can help me with my brother's problem. My brother came here as refugee in 6/97. He applied to adjust his status in 9/98. Has been fingerprinted a few times but still has not received a green card. The latest reply from INS in 2/03 is case still pending. Checking on this website, the NE center is now processing refugee application for I-485 in 2001. He also engage the service of a immg. lawyer in hope he can help him expedite his case but to no avail. He been down to the INS center several times and they kept telling him to wait. Do you think he can go ahead submit a complete new application. And if he can, does he have to cancel the pending application or just ignore it? Will INS accept his new application while the old one is pending. We don't know what is the problem with his file. His whole family has received green card a long time ago. They filed at the same time. I really appreciate any advice to his problem.

    I'd suggest contacting your local Congressional representative for assistance. BCIS is required to respond to Congressional inquiries, and I would guess from your description that his file has been lost (or misfiled) by BCIS.

    Thank you LawGal for answering my question. The congressional approach was made and same answer was given, "please wait"!!! I guess his only possible way is to refile. Cancel the pending application and resubmit a new one. My only question is "will INS accept his new application?". He is so frustrated since he is waiting for his GC and then USC so that he can go home and bring his wife here. It's been more than 5 years and his status is still in limbo. If anyone is familiar with the same situation, please share your experience with us and tell us how he can get out of this situation. Thank you in advance.
