Thread: umesh, sammy- marriage fraud

    if i do have sufficient evidence, written and otherwise, to prove that my current spouse and also his mistress conspired to commit ins fraud by coercing me to jointly sign the application to remove conditions of his temp GC on the basis of marriage, then perhaps not an ins issue, but is it possible to sue the mistress for the costs and fees, citizenship appliocation fees, etc, which i incurred to bring my husband here? After all, I married for love, and he and she planned to take advantage of me to get the GC, so indeed, isn't she the reason he has to go back?

    Josephine: Yes, I am aware of that, but considering that my husband will be out of the country, and it would be difficult to present him with a lawsuit, wouldn't it make sense to sue her first and she could, if she desired, then go to the trouble of subrogating the suit to him overseas. I guess my question should have been,
    "Is anyone aware of any precedent case where the petitioning USC spouse, who lost her/ his spouse to deportation, due to a case of marriage fraud, was able to sue for the costs, effort and other damages?"
