Thread: While I-485 pending wanted to change employer

    Hi all,
    I need advise from you all.
    My I-140 was approved on Dec-2001.
    My I-485 was filed on Apr 2002.
    Got EAD card on Aug 2002.
    Fp on Dec 2002.
    Already filed for renewing EAD card.
    Now I need to change an employer as got permanent offer.
    Can I do that?
    What happens If my company plans to revoked my I-140.? What can I do in this case?
    Can I file AC21 portability?
    What would be my status if they revoked I-140?
    Pls help me out,

    For you to port your I-140 to a new employer, you must have had your I-145 pending for 18 months. It seems your 485 has been pending only about 12 months. In your case, it doesn't seem like you can take your 1-140 and 485 to a new employer. If your 1485 is still pending for another 6 months, you will be then be eligible to port. At that point you could work for a different employer and still adjust on your initial 485 filed on the basis of I-140 filed by your then former employer (the employer that you are currently employed by).
