Thread: Can anybody answer this question?

    I was working on H1B until a year ago when I was laid off and my employment suddenly ended with my company. Of course, in theory I lost my legal status and I have not yet left the U.S. I am planning to leave soon however.
    I am not sure if my former employer ever withdrew the H1B petition since they did not know much about the regulations. I was their first foreign employee ever.
    Is there any way of finding it out without calling my old employer if they actually withdrew my petition?
    If they had withdrawn the petition, would the INS have sent me a notification about the withdrawal and the termination of my H1B status?
    I just want to know because I am leaving and want to see what to expect at the airport at departure when I submit my I-94 which is still valid until 2005, but I know in reality it expired when the terms of my employment ended last year.

    Do you have your receipt nuber (in California it starts with WAC). You may be able to check the USCIS online status to see if any action has been taken on your case. I am not sure if withdrawls show up, but it is worth a shot.

    You can look at http://uscis.gov/graphics/howdoi/h1b.htm
    You can looking another way.You can look for another employer in your experience or If you are single and you married a us citizen in good faith, you can adjust your status, without leave US.

    Nice of you all to help someone circumvent the laws of this country.

    Also try FOIR (freedom of information act) there you can request your entire file that BCIS has on you. it could take a few weeks or months untill you get it and will cost you a few dollars (maybe 20-50 at the most) but there you got everything you need to know! good luck
