Comment: SEC Indicts Immigration Counsel In EB5

SEC continues to pursue fraud in the EB5 program, for the first time announcing criminal indictments of immigration counsel. Please see two news items (the press release and the complaint) and two articles below. While SEC and USCIS are to be commended for increased enforcement efforts, much remains to be done. The proportion of EB5 cases transacted through broker-dealers has dramatically risen in the last year or two, a testament to the compliance message getting through to an extent. However, terms for the industry are still being set in China, by migration agents there, and outside of any meaningful US control - a clear indication that SEC and USCIS have a long way to go to sensitize EB5 players that the US government retains oversight over the EB5 program.
