    Can somebody tell me if the visa availability cut off dates were based on nationality or citizenship. Let say the person was from Mexico at the time the sponsorship was file and later on the same Mexican becomes Canadian Citizen, does his priority date changes because of his change of citizenship?

    INA 202 states that aliens are chargeable to their country of birth, but with some exceptions such as spouses and children being charged to the country of the main visa recipient.

    But, State and USCIS officers make mistakes, so it is worth trying to request (especially if you are having an interview) that they change your chargeability.

    How do you request to change the chargebility??

    It goes by country of birth if you are the beneficiary of the I-130. The fact that you are now a Canadian citizen does not change things.
