Thread: H-1B holders disqualifyed for UI Benefits

    I am a Canadian Citizen and worked in the United States on H-1B visa.
    My company was downsized and I was laid off.

    Massachusetts Division of Employment and Training disqualified me for unemployment benefits stating that I worked on H-1B and not able to work now.

    I am able and authorized to work in the United States under NAFTA as Canadian citizen.
    Now I legally stay in US with my family under TD (TN dependant) category.

    Does D.E.T. violate State/Federal Law?
    Am I eligible for receiving UI benefits?
