Thread: If the 245(i) is dead, Any options for this man?

    I posted the question about 245(i) to get answers for a man I know that needs answers.
    He is here after entering illegally to be with his wife and children who were already here on a visa. His wife's parents live here.
    He intended on going back but landed a good job and has been here ever since. Since landing this job, he is VERY much needed and it would put the company in a bind if he left.
    This man worries daily about his presence here and wants to be legal. However, without something such as the 245(i) he will be forced to go back to his country and risk being barred from entering the U.S. for up to 10 years. He doesn't qualify to apply for a visa since he's been here illegally for some time. He worries about being illegal and also about being deported. It would be a major hardship for his family to be without him.
    He is a very good man that has made a mistake and is trying to fix it. Some think that his only option is to stay here and try to get a tax ID number and a driver's license and just remain a tax paying person that is trying his best to fit in.
    Is there any options for him?

    hi, my husband was in that situation but we were lucky and were able to file under the 245i...however we still have not gotten anywhere with his papers and so it's like he is still here the same way...tell him to get his iti number get his drivers lin. and do the best he can . my husband has bee here for 5 years and from what we have been told they will not just come and deport you usually they go after those who are doing wrong here like getting in trouble with the law and things like that....i've heard the 245i will come around again so tell him not to worry and not to go and file anything with out the law because he will be subjected to the bar....
