Comment: Nationality Law

Immigration Daily has always covered both immigration law matters and nationality law matters, these topics being intimately inter-related as seen in the name of the organic act itself, the Immigration and Nationality Act. At one time, AILA was called "AINL", the Association for Immigration and Nationality Lawyers, in recent years, the association does not seem much concerned with nationality law, which involves, for instance, issues connected with native born US citizens obtaining US passports. One critical application of nationality law deals with whether derivative citizens, such as Sen. Ted Cruz (R-TX), qualify under the Constitution's "natural born" citizen language to run for President. The answer, according to a scholarly article we carry today, appears to be YES, albeit by action of statute, in terms of applicability. In a work up to his usual scholarly standards, Gary Endelman shows that jus sanguinis is also in the American tradition, complementing jus soli. In this age of globalization, more and more derivative citizens will likely become prominent in American politics, and in both parties. Some of them, will, in coming years, consider running for President. These derivative citizens should not be questioned as to their eligibility - the legal precedents appear quite weighty. We hope that Mr. Endelman's article will assuage those with legal doubts about such natural born derivative citizens' Constitutional standing to run.
