Thread: Want to get married. Need help!?

    I have been with an illegal immigrant for a little over a year and now we are talking about getting married. We do not live together yet. What is the process that we will have to do before we can get married? Or can we get married first then do paperwork or what? It is all confusing to me. He has been in the US for 5 years illegally. Could somebody please help me?

    If he enterd illegally, he will not be able to receive residency at this time by virtue of marriage to a USC. There are many, many others in that situation, and many have them have posted here. If he had been here less than 6 months illegally, then he could leave the country and wait for a fiance visa (about 3 months). Or you can wait for another stint of 245(i). Or perhaps one fo the new amnesties (did he enter at under 16 years old?) Under present law his only option would be for you to be married, apply for consular processing outside the country, and then apply for a waiver of his bar of amissability. He would risk not being allowed to return for 10 years.
