Thread: how can i get my green card?

    i`m married to a us citizen 4 years ago an i have a baby with him and i`m illegal and he just got his citizen 1 month ago.
    he doesn`t want to apply for me the green card until i sign a papers in which i will not have any rights and i refuse because he obliged me to do it or he gonna throw me as he said because i`m illegal.
    please i need help what should i do?

    Duh...change your subject line or the story. You never had a green card to begin with. So how can you state "MY" green card.

    It depends what rights he's asking her to give away. Presumably any custody agreements would be out the window etc, not to mention it would be considered a post-nup and depending where they live, it may not hold water anyway.

    As you say that you are married with this guy who is now a US citizen then you might be able to get a green card by yourself and without his help under VAWA law if you have been abused (physically, mentally/emotionally, and/or both) in the marriage.

    In my personal opinion, you are better off filing papers thru him because he wants to put a condition on you to help you to get a legal status than getting you a legal status out of love. Otherwise, how many husbands-wives out there who don't help their illegal-spouse to get a legal status if they are in love?? Btw, have you been with him all this time for a paper or love? Again, in my opinion, you shouldn't file any paper thru him because marriage based case takes a long time to get a full residency and I don't think he would stick around with you to get you a legal status based on marriage.

    You might think to explore VAWA option if you believe you have been abused in the marriage.

    What your husband may be proposing may be illegal under the state on what conditions you are agreeing to. Furthermore, if you are an overstay, you might be able to adjust your status using the I-360. However, if you entered without inspection, you will not be able to adjust your status whatsoever, unfortunately.

    My advice is to see legal and professional help concerning your husband. No one should put conditions on obtaining legal status through marriage whatsoever.
