Thread: Husband recvd green card and no I130 approval

    My husband received his green card last month after two I485 interviews. He's been here since 8/2006 on the K3 visa. The I130 had been in investigation since 4/06. 3 months ago I contacted them about the I130 and they sent a letter from chicago(where we live) and said it's still pending and we should here within 60 days or callthem back if nothing. They sent my husbands green card after approval of the I485 letter but we never got an approval on the I130. I have no clue and scared to call just in case they made a mistake, lol. Anyway, doesn't he need the I130 approved in order to eventually go for citizenship or to keep the green card valid?

    Interesting, but since the 485 was assigned to the same officer as the 130, you don't have anything to worry about. Just a mix up at USCIS.

    How do you know that the I130 and the I485 was assigned to the same officer? Is that standard proceedure? The one that approved my I130 was a very nice man, we had a little chat and I actually thought he'd see the difference.

    No, my husband did not have the same officer. The 1st one was a man and the second one a woman. I am also reading the USCIS is issuing green cards while I130's are still pending due to the back log from FBI name checks. If the person comes up with a red flag as not to issue the green card, I understand they take it away. I will have to call there coz I think we need this for the record. The whole reason why my husband didn't get his green card after filing the I485 was due to the hold up of the I130 in investigation.

    Always assigned to the same officer, unless a change for an unusual reason. In any event, you can't get a green card without an approved I130, so the letter is an obvious mistake.

    No, first officer was African American and the second was a caucasion woman. She was much more experienced, etc. Well it wasn't a mistake coz after they sent the letter of approval on the I485, the sent the green card one week later.

    spoke to uscis a bit ago. they transferred me to an officer who said it wasn't necessary to get a seperate letter stating the I130 has been approved because the I485 was approved and he received the green card. So I guess that's that, lol!
