    What to expect at an immigration court hearing and what are his chances?

    My fiance was in county jail for 7 months and after his sentence was over he was taken by INS. He is a permanent resident and has been living here in the U.S. for 18 years. His parents came here on asylum. We have a 5 year old son together. My question is, what should I expect on his court date and does he have a good chance to stay in this country? If the judge decides to give him another chance, will he be released from immigration jail right away? How many court dates does an immigrant get to fight their case?

    I am in the same situation myself..question what is the charge he is facing and has he had a conviction before.?

    Your fiance needs a good criminal/immigration lawyer inmediately.

    his past conviction was a DUI and his present conviction is breaking into a car with the intent to steal something in the car.

    he just had a court hearing on the 20th the lawyer motioned to dismiss the case and the judge accepted so he will be released on the 4th of oct.
