Thread: fiance refuses marriage

    My fiance petitioned for me to come to the US from Nigeria. Shortly before my papers expired, she told me that she will not marry me. Now my papers are expired, any advice on how I can obtain legal status to permanently stay in the US would be helpful.

    Did you arrive on K1-fiance visa?
    By "my papers" you mean I-94 you got when you entered the USA?

    If your answer is YES to both questions, there is NO way you can legaly stay in the USA. Not even if you marry somebody else.

    How long ago you arrived? Any chance you can talk to you finace and work things out?

    I did arrive on K1-fiance visa but I don't know what a I-94 is, can u please explain?

    I-94 is a small paper attached to your passport that has a stamp on it with the date 90 days from when you entered.
    It is a part of the form you filed out on the plane (most likely).

    Hi angelndskies39,

    Aneri seemed to have left, but I think she's referring to the document called the Arrival-Departure Record. The USCIS inspector will give this paper to you when you arrive at the US and you have to turn it in when you leave the US.

    Let me go and recheck my paperwork.
    The reason that I am asking these questions is that a lawyer told me that i could get married to a US citizen and go back to Nigeria for an interview and then return to the US and join my new wife. Is this a pack of lies to get more money from me by this lawyer?

You can become a permanent resident in the USA but you would have to leave first and get a new visa.

    Since my visa has expired and my fiance refuses to marry me can I marry another US citizen? If so, what are my chances of getting a new visa when I go back to Nigeria for a interview? Can't they deny me the ability to re enter the US?

    Their is no way to make up with my fiance, it has been 1 year and she said that the reason for her not marrying me is that her friends and family believe that I want to use her to become a citizen, which is not true, I did really love her.
