Thread: Will McCain's bill help an alien living abroad?

    Will the Secure America and Orderly Immigration Act hold any benefit for us? I live in Mexico with my husband, who was an EWI. He was never caught or deported, just returned of his own free will. We are currently awaiting our interview and know that he has the ten year bar. I am planning to file I-601.

    When I read the bill, it says that the ten year bar for those who have pending petitions when it is passed, could be waivered for $2000.00. Does it mean that it would be an AUTOMATIC waiver upon payment of the $2000.00, or would one still have to prove the exceptional hardship (as with the I-601)?

    PS I just want some opinions on how/if this bill would make a difference in our situation. I am not looking for political opinions regarding the bill itself or whether or not it will pass.
