Thread: Social Security Refund

    If we paid social security + medicare out of our pacycheck with employer contributions for 6 years as an valid H1B holder working in US, and due to delayed green card process and H1B issues, we have to go back to our country, can we get refund of all money paid by us + employer's contribution on date you leave your country? If so, how?pdoshi8@yahoo.com

    Nobody gets a refund of their social security or medicaid taxes.

    What you can get is a refund of your 401k and/or retirement plan if you had one. If they were tax-defered, you will have to pay taxes on them (about 20%) and maybe even a penalty if you are 65 or younger.

    They will send you a check (or deposit it on an account sometimes). It usually takes about 4 weeks to process.

    Not unless there is a Social Security Agreement between the US and the home country. If yes, you will need a certificate from the SSA international office. To find if there is one, you may visit: SSA Internaitional Agreements

    yes, you can get social security taxes refunded to you, if you hold F-1 visa and file form 843.

    Please read instructions for IRS form 843 for tax abatement and you will find out the truth. Good Luck

    cayita is wrong. i did get my ss refunded when i was on f-1 visa

    Question Is "IF YOU ARE ON H1B" answer is NO.
    SSN eligiblity only paid out after 40 qtrs. no benifit before complition of 40 qtrs.. even though there is a clause for young generation its not certain if SSA will have the enough funds to pay out to those who are contributing now.. chances are slim
    Its a discussion, not a legal advise..
