Thread: Need help on I-485 Form, Part 2

    I am a US citizen filing a I-130 for my husband who is living in the US with me and is from Uruguay. He came to the US on an I-94 Form in 2003. So,my question is: which of those areas should we check under Part 2 (a or b). We are filing the I-130 and I-485 at the same time, but not sure which of these to check. This is the only thing left to do, so thank you so much for anyone who can help us with this.

    You have two options. Check A and hope that there will be no issues (shouldn't be, since they would adjudicate the I-130 first, meaning that by the time they look at the I-485 he would have an approved immigrant petition). Or, check H and explain that you are filing the I-130 and the I-485 concurrently.
