Thread: Any Advice

  1. #1
My Father filed I130 for his wife with their son as a derivative. They are scheduled to receive their green card from Haiti. Now they are here in the U.S. and i have confirmed with USCIS that they are eligible to adjust status and get their green card here in the U.S.

I want to know what forms i need to file and send out.
Do i need to do the medical exams and everything at once, and send all of that with the original or first packet.

How long this whole process takes.

    Has the I-130 been approved?

  4. #4
Of course, it has been approved and the case is at the NVC.
    He is a permanent resident.

If their priority date is current and the wife and son are in status, then they can file for Adjustment of Status with the I-485. Concurrently, you can also file the I-765 and I-131.

Now, the son is a derivative. Do i need to file the I-485 for him too separately. OR just one form will cover both of them. What about the I-765, can both be included in it.

  7. #7
The wife and son each need their own set of forms.

  8. #8
Ok. Does that mean i have to pay the forms' fees for both of them too?

  9. #9
Yes- might be lower for son depending on age.

Ok. Thanks. He is 17 years old turning 18 next month.

So to make sure i understand.
I-485 Each will pay separately the fee ?
G328 The Biometric form Each will pay separately the fee ?
I765 Each will pay separately the fee ?
