Thread: False Information Charge on record.....

    My husband has a charge of giving False Info to a police officer from 2001. Will this prevent him from becoming legal?

    We had thought the charge was dropped but apparently it wasn't. I am getting ready to file my I-130 but want to know ahead of time if this is going to be a problem.

    Anyone know?

    HE WAS PULLED OVER AND TOLD THE OFFICER HE DIDN'T HAVE HIS LICENSE AND GAVE HIS BROTHER'S NAME. HE THEN TOLD THE TRUTH BUT THE OFFICER ARRESTED HIM.

    WE THOUGHT THAT A CLASS THE JUDGE ORDERED HIM TO GO TO WAS IN LIEU OF A CONVICTION BUT WE HAVE FOUND OUT OTHERWISE AND HE DOES SHOW A CONVICTION ON HIS RECORD.

    The key question is if his brother is a USC or not. What does the conviction say?

    If they really want to be harsh they might say that he pretended to be a USC which would make him inadmissable and even deportable.

    There wasn't much for him to be gained by claiming to be someone else but it depends how you look at it.

    I don't think he will have any trouble adjusting but you still have to include his criminal record.

    I don't want to alarm you but I just want to warn you that this is a possiblity.

    HIS BROTHER IS NOT A USC. HE GAVE FALSE INFORMATION TO AVOID GETTING ANY MORE TICKETS ON HIS RECORD. HIS BROTHER HAS A VALID LICENSE BUT NO LONGER LIVES HERE.

    I KNOW, STUPID, STUPID, STUPID! HOPE THAT DIDN'T RUIN HIS CHANCES.

    WHEN WILL THIS COME UP IN THE WHOLE PROCESS?

    I think you'll be fine, if it would show up it will when the background check is completed.

    Just be honest on the application and include any courtpapers along with a written statement axplaining the situtation.
