Thread: CSS denied

    My CSS case got denied on OCT 11th.Told me to appeal in AAO.Do I need to send my all evidence with I-694? Or only I can write a statement why my case shouldn't be denied? Also is anybody know any good lawyer in ATlanta area that can handle CSS/LULAC cases.

    Please advie.Thanks

    You should put all of your evidence together and present it, don't miss anything.

    taxreg16; what is the reason the USCIS denied your CSS?
    is this for your css Life Act or css late amnesty I-687?

    It is my css late amnesty I-687 case. LIFE still pending. They don't like affidavits. I have submit around 16 affidavits..still they don't like it.I have to present all my evidence or only just a brief why my case should not be denied?

    I am sorry to hear of your situation.

    If I am in your position, I would do the follwoing:

    1) Write a brief with very compling reasons why your case should not be denied. Don't write huge paragrahs---break it down to easy to read format. I like to use paragraphs with bullet points. This makes it easier for the immigration officer to read and therefore would be more understanding and willing to process if they see that you are organised.

    2) In the brief, I would site the provisions of the CSS legislation. With some research, you can find the law that states who is qualified and who is not and under what circumstances. March and provide evidence--again use bullet points such as A) Proof the I entered before 01.01.1982--SEE EXHITBIT 1. etc....

    3) Then behind this brief, insert pages by EXHIBIT A, B, C....separate your evidence in categories (receipts, affidivits, school transcripts, train/plane tickets, coipes of old passport, dirver's licenses, insurance, letters....anything you can find...)....

    You MUST be able to proof, how and where you entered and your continued existence from 1982 onwards...give them as many as you can find. Organized these in categories, then stack nicely as suggested.

    For the affidavits---did you have them notorized?? If you can get your parties to notorized them, it gives these more weight.

    In your affidavits, your must answer the who, where, what and why and how.... You cannot just say " Joe saw me here Jan 1988 and have Joe sign." Have each of these people write how they know you, when they know you, what they did for you, did they know you were trying to benefit from amnesty then, etc....

    I had about 6 different affidavits---I had them all write an easy for me, notorized them. While I was waiting for the approval of my application, two of these folks died. I had no problems getting these affidavits accepted.

    When I first applied, I took the suggestion of an attorney to present my case as I would in court in the above nicely organized manner. My case, very fortunately wasAPPROVED very quickly and while others had to go thru a few interviews etc... mine was approved without interview. I never saw an officer until I adjusted from temporary to permanent. It was then that I took the English exam and was told I am approved on the spot. At that interview...the officer said she never saw a more organized file and thanked me for making her job easy.

    See...if you make it easy for them to understand you and read your file, your chances are much better. But if all you do is throw them a bunch of paper and hope they figure it out....the chances are they they won't figure it out (human nature) and will deny.

    It is your duty to build your case.

    How long does it take to get the temporary residency card after the officer approves your case? For me he approved it in May, but then they called me back in October, he said for somereason the service center sent the file back to him, so he reviewed it and then re-approved it and said I should get my card in 2-3 months.

    My temporary card was almost instant. I did not know that my temporary status was approved. They just sent me the TEMPORARY RESIDENT CARD in the mail.

    But when I applied for the staus adjustment from temporary to permanent, was interviewed (English test) in April 06, called to go back with birth certificate in June 06-- was told that my case to adjust from temporary to permanent has already been approved, they just need to make the Green Card in name as shown on birth certificate. Then they sent out the Green CArd in October 06 according to their records.

    But I never received the card and or welcome package. That's a totally different problem we have to deal with---someone some where along the lines (from card issues to mail delivery) is stealing the cards.

    If there is any comfort, my name and SS# reflects APPROVED LEGAL PERMANENT STATUS on their system---that's most important. Waiting for card to be resent.

    Hope I have given you some help there.

    Well as long as you're passport is stamped once your green card is approved that's the main thing. For me that's about a year or so away because I still haven't received my temporary residency card yet. I just don't want to reapply for the EAD its a few bucks mind you, and then once I get that, get the other one the next day in the mail. I wish this system was more straight forward and fast.

    Stamping passport?? I have asked so many times and have even went thro INFOPASS--- still not stamped.

    They wanted me to file the I-90. First office told me check a certain box and DON'T have to pay cos I did not move within the last 10 years. They I can get my passport stamped.

    I filed the I-90 as instructed. But no....I called and called and called...they say its going to take more than 6 months before my I-90 will show up on the system to get my passport stamped because I did not pay.

    Well....you know you have to go back and forth, back and forth with these officers and everytime its something different.

    So I am still waiting to get the passport stamped.
