Thread: Confused...HELP ! I 130 Approved BUT ????

    Ok here is the situation: My wife and I married in Sept 2007, after being together for over a year. She had a deportable status prior to us getting married so we decided to deal with this issue in Immigration Court in Oct 2007. Shortly thereafter, the deportable case against her was re-opened, pending applications that were going to be submitted i.e. I 130, I, 765 and I 485. We hired an attorney and all necessary applications mentioned were submitted in Jan 2009. My wife completed the biometrics in April 2009 but they were rejected/denied because accordingly to what he heard, the deportation case was still pending the approval of the I 130. In March 2009, we received the I 130 interview letter scheduled for June 2009 which we went to and (5) days later we were approved in CT. The Immigration officer told us that we would be receiving a letter from the Immigration Court regarding an appointment to return to court and deal with the deportation adjustment status or (I guess possibly closing this case?). We received this letter in August 2009 scheduled for December 2009. We kept this appointment in Immigration Court but the judge did not close this deportation case but instead adjourned the case for October 2011. The Immigration Judge knew that we were already approved for the I 130. Ok here are my questions:

    1) If an I 130 is approved why not close this deportation case during this supposedly master hearing?
    2) Why didnít the judge grant working papers during this court date in Dec 2009?
    3) Would my wife be able to obtain working papers now or have to wait until 2011?
    4) Biometrics already were completed before although she was denied prior to the I 130 approval so in this case, would she have to re-do the biometrics?
    5) Has anybody heard of waiting 2 years for a I 485 court date hearing or waiting for 2 years after having I 130 approved?
    6) Is it typical for the court to grant an approval for the I 485 in my wifeís case or does Homeland Security grant that decision?
    7) Although we have a scheduled date to return back to court in October 2011, has anyone ever tried to obtain an earlier date by writing a letter?

    Nothing happens at the Master Hearing except scheduling another hearing if the alien is not in custody. You just have to wait for the next hearing and request a dismissal of the deportation based on the approved I130.
